ANT DESIGN LTD.

1. INTRODUCTORY PROVISIONS

  1. These Terms of Use govern the rights and obligations between the trading company ANT DESIGN LTD , UIC 207139499 (hereinafter referred to as the "Supplier") and other persons using the services of shopstyler.co.uk (hereinafter referred to as the "User") arising from service contracts (hereinafter referred to as the "Service Contract") concluded through the Supplier's website at: shopstyler.co.uk(hereinafter referred to as the "Website"), or through Facebook. The Terms of Service further govern the rights and obligations relating to the use of the shopstyler.co.uk service, the Website and other related legal relationships.
    The Provider is entitled to modify or supplement the Terms of Use. Changes shall take effect upon posting on the website.

 

2. CONTENTS OF THE SERVICE CONTRACTА

  1. Pursuant to the Service Agreement, the Supplier undertakes to include the User in the shopstyler.co.uk system. The User undertakes to provide his valid personal data (see sections 8 and 9).

 

3. CONCLUSION OF THE SERVICE CONTRACT

  1. The contract for the service is concluded by entering the User's email address on the website or by the User logging in via Facebook. For the purposes of the Terms of Service, the email address provided by the User is deemed to be correct. The User agrees that the Provider may commence to provide the Service in accordance with the Service Contract immediately after the conclusion of the Service Contract. Any costs incurred by the User in connection with the use of remote communication means to conclude the Service Contract (e.g. internet connection costs) shall be borne by the User.

 

4. TERMS OF SERVICE

  1. The Provider is not obliged to provide the service if it is prevented from providing the service due to problems on the part of the User or other persons. The Supplier is not obliged to provide the service, especially in the event of power failure, data network failure, other malfunctions caused by third parties or in case of force majeure.
    Suspensions, temporary restrictions, interruptions or degradation of quality may occur when the service is provided.


5. LIABILITY OF THE SUPPLIER FOR DEFECTS IN SERVICE, COMPLAINTS

  1. The rights and obligations of the Parties with regard to the liability of the Supplier for defects in service shall be governed by the applicable generally binding legal provisions, namely the provisions of paragraphs 499 et seq. of Law No. 40/1964 Coll., Civil Code, as amended (hereinafter referred to as the "Civil Code"). The User shall exercise his rights arising from the Supplier's liability for defects in the service with the Supplier in writing by e-mail sent to the contact address (section 12.4).

 

6. USING THE SERVICE

  1. The service should only be available to the User. The User may not allow third parties to use the Service without the prior consent of the Provider.
    In connection with the Service, the User may not use any mechanisms, tools, software or procedures that have or could have a negative impact on the operation of the Provider's equipment, the safety of the Internet or other Internet users.
    User shall not engage in any activity that could block or restrict the operation of the Provider's server where the Service is performed, otherwise attack the server, or assist a third party in such conduct. In particular, the User must not load the Provider's server where the service is executed with automated requests.

 

7. OTHER RIGHTS AND OBLIGATIONS OF THE PARTIES

  1. The user is aware that any software comprising the website is subject to copyright. The User undertakes not to carry out any activity that would allow the User or third parties to interfere with or use without permission the software whose ownership or usage rights belong to the Provider.
    With regard to the User, the Supplier is not bound by any code of conduct within the meaning of section 53a para. 1 of the Civil Code.

 

8. PRIVACY AND CONSENT POLICY FOR SENDING ADVERTISING MESSAGES

  1. The personal data of the User, who is a natural person, are protected in accordance with Law No. 101/2000 Coll., on Personal Data Protection, as well as new amendments.
  2. The User, who is a natural person, consents to the processing of the following personal data: email address, city/location, interests indicated on the shopstyler.co.uk service, basic data provided by Facebook, list of friends on Facebook and the User's email address on the Facebook account (hereinafter collectively referred to as "Personal Data").
  3. The User gives consent to the Provider to process the User's Personal Data in order to fulfil the obligations under the Service Contract and with the sending of other advertising messages by the Provider.
  4. The Provider may use a third party as Data Controller to process the User's personal data.
  5. The User is aware that he is obliged to provide correct and accurate personal data and to inform the Provider immediately of any changes thereto.
  6. Personal data is processed indefinitely. Personal data is processed electronically by automated means or in printed form by non-automated means.
  7. The User confirms that the personal data provided by the User is accurate and that the User has been informed that the provision of personal data is voluntary. The User declares that he/she has been informed that he/she may withdraw his/her consent to the processing of personal data by the Provider by written notice delivered to the address of the Provider.
  8. If the User believes that the Provider or the Data Controller (paragraph 8.4) is processing the User's personal data in a manner contrary to the protection of the User's privacy or in violation of the law, especially if the User's personal data is inappropriate in relation to the purpose of its processing, the User may:

    • asked the Provider or Administrator for an explanation,

      ask the Provider or Administrator to rectify the situation. This may include blocking, changing, adding or destroying personal data in particular. If the User's request under the preceding sentence is deemed justified, the Provider or Administrator will immediately rectify the defect. If the Provider or the Administrator does not comply with the request, the User has the right to contact the Data Protection Office directly. This provision is without prejudice to the User's right to contact the Data Protection Authority directly in this context.

  9. If the User requests information about the processing of his personal data, the Provider is obliged to provide such information to the User. The Provider shall be entitled to charge a reasonable fee for providing the information in accordance with the preceding sentence. However, such fee shall not exceed the costs necessary to provide the information.

  10. The User consents to the sending of information and advertising messages by the Provider that are related to the Provider's services or business to the User's address.

 

9. TERMINATION OF THE SERVICE CONTRACT

  1. The consumer who is a consumer within the meaning of Art. 3, Law No. 40/1964 Coll. of the Civil Code, as amended (hereinafter referred to as the "Civil Code"), has the right, pursuant to the provisions of paragraph 53, Article 8A of the Civil Code, to withdraw from the Service Agreement by sending a request to terminate the use of the Service from the email address provided by the User when concluding this Agreement.

 

10. WEBSITE USE

  1. The User or any other person using the Website acknowledges that he/she will not be entitled to use the texts, graphic works or other objects that can be found on the Website and are protected by copyright without the prior written consent of the Provider.
    The User agrees that it may only place such content on the Website that has been created by the User or whose author has given the User consent to make the content available on the Website. The User indicates that by placing and making the content available on the Website, no copyright or other rights of third parties are infringed and no generally binding legal provisions are violated.
    To the extent provided for in section 5 of Act No. 480/2004 Coll. for certain information society services and in accordance with this provision, the Provider shall not be liable for the activities of users.
    When using the Provider's website (server), the User may not use mechanisms, software or other procedures that may or could have a negative impact on the operation of the Website or server.
  2. The User has the right to post information on the Website. This includes creating sets (collages), collections, uploading images and posting comments (hereinafter referred to as "Contributions") in particular. Contributions represent the views of the Contributor and do not represent the views of the Provider. The Provider is not responsible for the accuracy of the information contained in the Participation and for the compliance of such information with legal regulations.
    The Supplier shall be entitled to remove any Submission without assigning any reason.
    Once published, the Entries shall become the property of the Provider and their author shall thereby assign the rights relating to such Entries, even if they are deemed to be a work within the meaning of Act No. 121/2000 Coll, on Copyright: to use, modify, copy, distribute, transmit, publicly perform, reproduce, publish, sublicense, transmit or sell such communication and to create derivative works thereof, or to assign the license with unlimited rights to a third party to exercise any of the aforementioned rights granted in connection with such Participations.
    By posting a Participation, User waives any right to royalties and indicates that it will not restrict the manner in which Participations posted by User will be used.
  3. The User is not entitled to any remuneration for posting a Participation.
    The Provider shall be entitled to grant the right to use the Participations to a third party (as exclusive or non-exclusive).
     

 

11. OUR SEARCH ENGINE

  1. For a complete list of search engine results on the website, we search the product names and descriptive texts among the several million commercial offers that are provided to us. When searching, we also include product category names and/or product features. We list the product search results according to the relevance of the result. Search results based on product names have higher relevance than results based on descriptive texts. We show products where the search term appears in the bid name higher in the search results list than other products.
    Multi-word searches can produce results where terms do not appear continuously. Of these, among others, queries may be affected by some branded products in conjunction with common terms. A search for "brand name pants" may find not only the pants of relevant designers, but also those bids that use the brand name in their bid text. This can happen if the brand name has a descriptive or abbreviated meaning.

12. FINAL PROVISIONS

  1. If the relationship related to the use of the Website or the legal relationship established in the service contract contains an international (foreign) element, the parties agree that the relationship shall be governed by Bulgarian law.
  2. All disputes arising out of or in connection with this Agreement shall be settled in court.
  3. The Service Contract, including the Terms and Conditions, shall be archived by the Provider in electronic form and shall not be available to the public.
